1. Introduction
Welcome to ObraXRAY (accessible at obraxray.com). By using our services, you agree to these Terms and Conditions. Please read them carefully before using the platform.
2. Description of Services
ObraXRAY is a risk verification platform for Portuguese construction contractors. The service allows free basic searches and the purchase of ObraCheck reports with detailed risk analysis, including court proceedings (CITIUS), construction licences (IMPIC), commercial registry data (NIF.pt), and information about company directors.
3. Data Sources
All information presented by ObraXRAY comes exclusively from official public sources, namely CITIUS (court proceedings), IMPIC (construction licences), NIF.pt (commercial registry), and the Ministry of Justice publications (publicacoes.mj.pt). ObraXRAY aggregates and presents this information in a structured format but does not produce or validate the data at its source.
4. Informational Nature
The information provided by ObraXRAY is exclusively informational and does not constitute legal, financial, or professional advice. The risk score is an automatically calculated indicator based on public data, not a decision recommendation. We always recommend consulting qualified professionals (lawyers, engineers, etc.) before making decisions about hiring construction services.
5. Data Accuracy
We strive to keep data up-to-date and accurate, but we do not guarantee the accuracy, completeness, or timeliness of the information. Data comes from public sources that may contain errors, omissions, or be outdated. The absence of negative records does not guarantee a contractor's reliability.
6. Payments
Payments are securely processed through Stripe. Prices include VAT at the applicable legal rate. ObraCheck reports are one-time purchases: every purchase comes with a permanent PDF (a snapshot of the data from the last update), 90 days of online access to the contractor profile and automatic alerts during that period. Re-verification within 12 months costs 9.99 EUR and renews the 90 days with fresh data. Individual purchases and packs of 3 credits valid for 12 months are available. Continuous Protection is an optional one-off add-on that adds 12, 24 or 36 months on top of the current coverage window of a report already purchased, counted from the current coverage end date. Extensions stack, with no lifetime cap, and the PDF stays unchanged (original snapshot). There is no auto-renewal. Each extension is billed individually and issued as a compliant SAF-T PT invoice. The service starts the moment the payment is captured and, under DL 24/2014 Art. 16 al. m), the user waives the withdrawal right when accepting immediate service start on the extension.
7. Right of Withdrawal
Under Portuguese Decree-Law No. 24/2014 of 14 February, consumers have the right to withdraw from the contract within 14 days without giving any reason. However, when purchasing an ObraCheck report, the consumer expressly consents to the immediate provision of the digital service and acknowledges that, upon delivery of the report, the right of withdrawal is waived, as provided for in Article 16(m) of said decree. This consent is explicitly collected before payment.
8. Intellectual Property
ObraXRAY, including the platform, design, logo, risk calculation algorithms, and report structure, are the property of ObraXRAY. Purchased reports are for the buyer's personal and private use and may not be reproduced, distributed, or commercialised without prior authorisation.
9. Limitation of Liability
ObraXRAY is not responsible for: decisions made based on the information provided; losses or damages resulting from the use of the services; errors or omissions in public data sources; temporary unavailability of external data sources; or incorrect interpretations of the data presented. ObraXRAY's liability for damages arising from the use of the service is limited to the amount paid for the service in question, except in cases of intent or gross negligence, personal injury, or where mandatory law provides otherwise. The report is an informational element and does not replace consultation with qualified professionals. Users should verify information with official entities before making decisions.
10. Digital Content Conformity
Under Portuguese Decree-Law No. 84/2021, ObraCheck reports constitute digital content subject to conformity requirements. If you believe a report contains incorrect or incomplete information relative to the data available in the consulted sources at the time of generation, you may request a correction or the issuance of a new report via contact@obraxray.com. If the non-conformity cannot be corrected, you are entitled to a proportional price reduction or a refund. Conformity is assessed against the data available in public sources at the time the report was generated, not against all information that may exist about the company.
11. Complaints Book
In compliance with Portuguese Decree-Law No. 156/2005 of 15 September and Decree-Law No. 74/2017 of 21 June, we provide access to the Electronic Complaints Book at www.livroreclamacoes.pt. You may also submit complaints directly via our support email.
12. Governing Law and Dispute Resolution
These terms are governed by Portuguese law. For consumer disputes, you may use the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr) or an authorised Alternative Dispute Resolution (ADR) entity. In case of judicial litigation, Portuguese courts shall have jurisdiction.
13. Changes to Terms
We reserve the right to change these terms. Changes will be published on this page with the updated date. For substantial changes, registered users will be notified by email at least 15 days in advance. Continued use of the services after the notification period constitutes acceptance of the new terms.
